A
 Federal High Court in Abuja will today deliver judgment in the suit by 
leader of the Islamic Movement in Nigeria (IMN), Sheikh Ibrahim Zakzaky 
challenging his continued detention by the Department of State Services 
(DSS).
Justice Gabriel 
Kolawole had fixed the judgment for today after his earlier advice to 
the applicant's lawyers and the Federal Government to settle the dispute
 out of court by November 25 failed.
Zakzaky's counsel 
Femi Falana (SAN) and Festus Okoye had earlier told the court that their
 client had nothing to negotiate because he and his wife had not been 
charged with any offence.
In the fundamental 
rights enforcement suit, Zakzaky is also demanding the sum of N2 billion
 in damages against the Nigerian Army, the DSS, and Attorney General of 
the Federation over his detention without trial since December, 2015.
But in a counter 
affidavit, federal government's counsel, Tijjani Gazalli, claimed that 
Zakzaky was being held in protective custody to prevent being attacked 
by aggrieved residents of Gyallesu community, Zaria, Kaduna State, the 
spiritual headquarters of the sect.
